Sir John Charles Frederick Sigismund Day was born at the Hague, the son of Captain John Day and his wife Emilie (née Hartsinck). He completed his schooling at Downside, and, prevented from attending the Universities of Oxford and Cambridge by his Catholic faith, attended the University of London, where he obtained his B.A. in 1845. In 1845 he went to the Middle Temple, and in 1882 he was called to the Bar and became a judge. He gained a reputation for sentencing criminals to lashes. In 1902, he was appointed to the Privy council.
